Subject

2.1 These Terms and Conditions govern the online purchase of books, lithographs, prints, design objects, fashion and beauty items, jewelry, stationery, gift ideas, and handcrafted items published by Archivio Crepax S.r.l. through the website www.guidocrepax.it.
2.2 The applicable General Terms of Sale are those in force at the date the purchase order is sent by the User and are available in Italian.
2.3 Archivio Crepax S.r.l. reserves the right to modify the General Terms of Sale at any time. Any changes and/or new terms will take effect from the moment they are published on the Site in the “General Terms of Sale” section, indicating the version and update date. Users are therefore encouraged to regularly consult the dedicated section.
2.4 The offer and sale of Products through the Site constitute a distance contract governed by Articles 45 et seq. of Legislative Decree No. 206 of 6 September 2005, as amended (Consumer Code), and by Legislative Decree No. 70 of 9 April 2003, containing provisions on electronic commerce.
2.5 To place an order for a Product, it is necessary to read, carefully examine, and understand these “General Terms of Sale.”
2.6 By sending the order, these Terms and Conditions are considered accepted.

 

Purchase via the Website

3.1 Purchase of Products through the Site is permitted for Users who are consumers pursuant to Article 3, paragraph 1, letter a) of the Consumer Code, as well as Users who are not consumers, provided they are at least 18 years old. To verify the minimum age required by law, Archivio Crepax S.r.l. reserves the right to request the tax code or other identification document. If the User is under 18, they will be prevented from completing the purchase process and submitting the order. In any case, if for any reason, including technical reasons, the purchase order is sent, it will be immediately canceled pursuant to Article 1456 of the Civil Code, given its contradiction with the General Terms of Sale and/or applicable law. The User will be promptly informed via email of the order cancellation, and if payment has already been made, Archivio Crepax S.r.l. will refund the Total Amount Due, including the product price, shipping costs (if applied), and any other additional fees indicated in the order form, according to the payment method used.
3.2 Products may be purchased by both Users with a User Account and Guest Users.
3.3 Archivio Crepax S.r.l. reserves the right to refuse or cancel orders from (i) a User involved in ongoing legal proceedings with the company; (ii) a User who has previously violated these General Terms of Sale and/or the terms of the purchase contract with Archivio Crepax S.r.l.; (iii) a User involved in any type of fraud, particularly credit card fraud; (iv) Users who provided false, incomplete, or inaccurate identification data or who failed to promptly provide requested documents or provided invalid documents.

 

Products

4.1 Products offered include, by way of example, books, lithographs, prints, design objects, fashion and beauty items, jewelry, stationery, gift ideas, handcrafted items, and other original editorial products related to the work of Guido Crepax.
4.2 All descriptions, images, and prices are carefully updated, but errors or changes may occur without notice.
4.3 Each Product is accompanied by a Product Sheet. Images and descriptions on the Site aim to faithfully reproduce the Products. However, colors, dimensions, and other product features may differ from reality due to user device settings. Images are therefore indicative, with standard tolerances. For contractual purposes, the Product description in the order confirmation prevails.
4.4 Some products offered on the shop are vintage items, which may show signs of wear, minor imperfections, or defects due to age and previous use. These features are part of the product’s unique value and character and are not considered defects under applicable law. By purchasing, the Customer expressly accepts this condition.

 

Product Availability

5.1 Products offered on the Site are those displayed on the homepage and/or within the various pages of the Site at the time of the User’s order.
5.2 Product availability is shown on each Product Sheet and is continuously monitored and updated. Because multiple Users may visit the Site simultaneously, more than one User may attempt to purchase the same Product at the same time. In such cases, the Product may appear available briefly, even if it is actually out of stock or not immediately available.

 

Prices and Payments

6.1 Product prices are expressed in Euros and include Value Added Tax (VAT).
6.2 Archivio Crepax S.r.l. reserves the right to change Product prices at any time without notice. However, the price charged to the User is the one indicated at the time of the order and does not reflect subsequent price changes, except in cases where listed prices are clearly inconsistent with the normal market price due to obvious material errors.
6.3 If a Product is offered at a discounted price, the Product Sheet will indicate (i) the original reference price, (ii) the discount percentage applied, and (iii) the resulting discounted price. The original reference price is the price at which the Product was previously offered on the Site.
6.4 Payment for Products purchased on the Site can be made via credit card or PayPal.
6.5 Payment must be completed at the time of the order.

 

Conclusion of the Contract

The purchase is considered concluded when Archivio Crepax S.r.l. receives confirmation of the order and payment. The User will receive an order confirmation via email.

 

Shipping and Delivery

8.1 Products will be shipped to the address provided by the customer.
8.2 Delivery times are estimated at 10–12 business days within Italy and 20–24 business days worldwide, excluding customs formalities.
8.3 At the time of shipment, the User will receive an email confirming delivery to the carrier, including a link to track the shipment. Archivio Crepax S.r.l. is not responsible for delays caused by the courier.
8.4 It is the User’s responsibility to verify the condition of the delivered Product. Risk of loss or damage not attributable to Archivio Crepax S.r.l. transfers to the User when they (or a designated third party other than the carrier) take possession of the Products, except where loss or damage is caused by gross negligence or intentional misconduct of the carrier. Partial loss or damage not recognizable at delivery must be reported within 8 days. If the package shows signs of tampering, the User is advised to accept delivery with reservation and notify Archivio Crepax S.r.l. promptly.

 

Right of Withdrawal

9.1 In accordance with Legislative Decree 206/2005 (Consumer Code), where applicable, the customer has the right to withdraw within 14 days of receiving the product. To exercise this right, a written notice must be sent via certified email to archiviocrepax@registerpec.it or by registered mail, specifying the order number.
9.2 The product must be returned intact and in its original packaging. Return shipping costs are the responsibility of the User.
9.3 Archivio Crepax S.r.l. will refund the Total Amount Due without undue delay, and in any case within 10 days of being informed of the User’s decision to withdraw. Refunds will be made using the same payment method unless otherwise agreed.
9.4 The User is responsible for any decrease in value resulting from handling the Product beyond what is necessary to determine its nature, characteristics, and functionality. The Product must be stored, handled, and inspected with due care and returned intact, complete, with labels attached, and free from signs of wear or dirt. Otherwise, the refund will be reduced accordingly.

 

Warranty

In the case of defective or non-compliant products, the warranties provided by the Consumer Code apply.
Products are copyright-protected, and all intellectual property rights are reserved. Any reproduction, distribution, or publication, in whole or in part, is prohibited, as is any use other than personal.
Signed lithographs and other products indicated as original are certified by Archivio Crepax.
“Handcrafted” products on the site are authorized reproductions granted by Archivio Crepax.

 

Limitation of Liability

Archivio Crepax S.r.l. is not liable for any direct or indirect damages arising from the use of the website or inability to access it.

 

Customer Service and Complaints

For information, communications, assistance, or complaints, contact Customer Service at archiviocrepax@guidocrepax.it.

13.1 Except as otherwise provided by law, Archivio Crepax S.r.l. shall not be liable for Products and/or Digital Content, or for non-performance, delays, or disruptions caused by circumstances beyond its control, including force majeure such as pandemics, natural disasters, adverse weather, fires, floods, earthquakes, strikes, sabotage, malfunction, or failure of communication, electrical, or telephone networks.
13.2 The User acknowledges and agrees that, in any case, the liability of Archivio Crepax S.r.l. shall not exceed the sums paid by the User for the purchase of the Product or Digital Content.

Governing Law and Jurisdiction

The contract is governed by Italian law.
For any disputes, the competent court is that of the consumer, if applicable, or the Court of Milan.
